Silent and Live Auction Guidelines
Income Tax Information
Each Lot in the Silent and Live Auctions has a general price estimate, but this estimate does not constitute an opinion of Gala Committee or its donors as to the fair market value of the Lot or tax treatment of the amount paid. For Federal Income tax purposes, the purchase price of a Lot may be deductible to the purchaser only to the extent that such amount exceeds the fair market value of the Lot. It is the responsibility of the purchaser to establish the fair market value and the amount of any tax benefit.
The Second Night for the Children Gala is a charity auction and Gala benefiting CARE and the Nelson Mandela Foundation. Lots are described in the Auction Catalogue as precisely as ascertained by the donor and no returns will be accepted. Purchases of Travel, Dining and Service items will receive a “prize-letter,” “gift-certificate” or “voucher” relating to the Lot. The Gala Committee does not assume further responsibility for the coordination of the trip, dinner or any reservations. It is the responsibility of the bidder to make all arrangements with the donor of the Lot purchased.
Conditions of Sale

· The Gala Benefit Committee is not responsible for the condition of any Lot, and makes no warranties or representation of any kind with respect to the Lot or service sold;
· No Lot may be exchanged, returned, or redeemed for cash substitutions. All sales are subject to final confirmation by Gala Benefit Committee;
· A bidder in the Live Auction may retract a bid at any time before the Auctioneer announces that it has been “sold.” A bidder in the Silent Auction may retract by simply crossing out his name and phone number from the bidding sheet before 9:30 p.m., and the prior bid shall immediately revive;
· Once a bidder is acknowledged by the Auctioneer to be the winner, title to the Lot will pass to him/her, who thereupon assumes full risk and responsibility for the Lot;
